Many people wonder, “Does a passenger have a claim in a car accident?”
The law in Texas is clear: Anybody who has been injured in a car accident has a claim against anybody who is responsible for that accident.
How does this apply to passengers? In a typical car accident the passengers have a claim against everybody responsible for that accident: Their own driver, the other driver, or both drivers. In a single vehicle accident the same is true – the passengers have a claim against the driver. This is true even if the passengers are related to the driver. This is true even if the passengers are married to the driver. This is true even if the passengers are listed on the insurance policy.
One thing to remember is that sometimes a passenger will have their own car insurance. So, if they are injured sometimes their own car insurance will cover those injuries even though they weren’t driving.
