Probate is the legal process for settling the estate of a deceased individual. It includes the court process of proving the validity of a will, if one exists, and/or determining proper heirs to the estate (determined either by the will or by the laws of intestacy if the decedent did not have a will). Probate administration includes the collection and management of estate assets, payment of debts and distribution of property to the appropriate heirs.
